How can a smoke shop get credit card processing?

Short answer: Apply with a processor that approves tobacco retailers rather than a mainstream payment app that may close the account later. Underwriting usually asks for your tobacco retail licence, a business registration, recent processing or bank statements and your age-verification process. Merchant Fund Express works with processors that approve smoke shops.

Key facts

  • Tobacco is a restricted category for many processors
  • A state or local tobacco retail licence is usually required
  • Tobacco 21 age rules apply to every sale
  • Accurate product descriptions prevent account freezes

Can a smoke shop get a merchant account?

Yes, but not from every processor. Many mainstream payment apps list tobacco, smoking accessories and "paraphernalia" in their restricted-business rules, and some only discover what a shop sells after it starts processing. That is when accounts get frozen and deposits get held. A smoke shop needs a processor that underwrites the category on purpose.

Merchant Fund Express works with processors that approve smoke shops and tobacco stores. We match your equipment to the processor that approves you, set it up and stay on the phone afterwards. There is no published price list: processing is quoted to your business, and we review your current statement for free.

Why processors treat smoke shops as high risk

Age-restricted products

Federal law sets 21 as the minimum age for every tobacco and nicotine product, and many states and cities add their own rules. A sale to a minor is a compliance problem for the shop and for the processor that handled the card.

Product mix scrutiny

Glass, pipes and accessories sit near the line of federal drug-paraphernalia law, which exempts items primarily intended for tobacco use. Underwriters look at how products are described and displayed.

Regulatory change

Flavor bans, local license caps and new hemp rules change what a shop may legally sell. Processors price in the chance that a product line becomes illegal in your area.

Card-network monitoring

Visa and Mastercard watch dispute and fraud ratios. Categories with more disputes get closer monitoring, so processors approve them carefully.

What underwriting usually asks a smoke shop for

Your state tobacco retail license, and the city or county license where one is required.
Business formation documents, a voided check or bank letter, and the owner's ID.
Recent processing statements if you already take cards. They show your dispute history, which matters more than anything else on file.
A product list or photos of the store and website, so the underwriter sees what is actually sold.
Your written age-verification process: ID checks at the counter, and how staff are trained to refuse a sale.
If you sell hemp or CBD items, certificates of analysis for those products (see our CBD store page).

Rules that shape a smoke shop's setup

Tobacco 21. Since December 2019 the federal minimum age to buy any tobacco product, including cigars, pipe tobacco and e-cigarettes, is 21. FDA guidance tells retailers to check photo ID for anyone who appears under 30. Your POS can prompt staff with an age check on every restricted item, which is evidence an underwriter likes to see.

State and local licenses. Most states require a tobacco retail license, and many cities limit how many shops can operate or how close they can be to schools. Underwriters check that the license matches the address and the legal name on the application.

Flavor and product bans. Several states and cities restrict flavored tobacco or certain products. If your area bans something, it cannot be in your product list, in-store or online.

Hemp products. A federal law signed in November 2025 tightens the definition of hemp and caps intoxicating hemp products per container. Natural hemp restrictions are scheduled to take effect in December 2026. Shops carrying delta-8, THCA flower or similar items should plan for that change now, because processors will.

In-store versus online

Selling channelWhat changes for processing
In-store counterCard-present sales, ID checked in person, lowest dispute risk. The usual starting point for approval.
Online storeCard-not-present, higher risk. Online tobacco and nicotine sales carry federal delivery-sale rules, age verification and carrier restrictions.
Delivery from the shopTreated like online sales for many rules: ID must be checked at the door, and local delivery may need its own approval.

Keeping your account open and your deposits flowing

Describe your products accurately on the application. Accounts are usually closed for surprises, not for the category itself.
Expect a reserve to be discussed. A reserve is a share of sales the processor holds for a period as a cushion against disputes; it is released on a schedule. Strong history and clean statements are the way to shrink or remove it over time.
Keep disputes low: clear receipts with your shop name, a posted return policy for accessories, and fast answers when a customer calls about a charge.
Tell your processor before you add a product line, a second location or an online store.
Keep licenses current. An expired license can trigger a review even when sales are clean.

How we set up a smoke shop

1. A short call

Call (305) 384-8391. Tell us what you sell, how you sell it (counter, online, delivery) and roughly how much card volume you run. If you already process, have a recent statement nearby for a free review.

2. Matched to a processor that approves your category

We work with processors that knowingly accept this business type instead of ones that close accounts once they notice what you sell. Your equipment is matched to the processor that approves you.

3. Paperwork, once

We tell you exactly which licenses, IDs and statements the application needs, so underwriting is not a slow back-and-forth.

4. Live and supported

Once approved, your terminal or gateway is set up and tested, and you keep one number to call when something needs attention.

Funding for a smoke shop

Merchant Fund Express also arranges business funding, and we would rather be straight with you about it on this page than on the phone. Funding eligibility is set by industry code (NAICS), and tobacco stores are on the restricted list for the bank-style tier. The revenue-based tier reviews some restricted categories under its own rules, and the answer depends on the file.

The eligible industries page explains how codes are read, and funding requirements lists the revenue, time-in-business and bank-activity thresholds. If funding is not a fit, processing still is: the two are separate products, and we will tell you which one we can help with on the first call.

Common questions

Will a regular payment app work for my smoke shop?

Some mainstream apps restrict tobacco and smoking accessories, and accounts can be closed after the fact. A processor that approves smoke shops up front is the safer route.

Do I need a special terminal?

No special hardware is required by law. The terminal is matched to the processor that approves you, and we set it up to prompt for ID on age-restricted items.

Can I sell online with the same account?

Online sales are reviewed separately because they are card-not-present and carry federal delivery-sale rules for tobacco and nicotine. Tell us up front and we will set it up correctly.

What is a reserve?

A portion of your sales held for a set period to cover possible disputes, then released on a schedule. Whether one applies, and for how long, depends on your history and the processor.

Do you publish rates?

No. Processing is quoted to your business after a short call, and we review your current statement for free.
