The Equal Credit Opportunity Act, implemented by Regulation B, prohibits creditors from discriminating against applicants on the basis of age, as long as the applicant can legally enter a contract. It covers business credit. A funder can look at your business, your credit and your capacity to repay; it cannot hold your birthday against you.
For owners in their 50s and 60s, the bigger issue is usually not getting approved. It is what the financing puts on the line. Many business loans and advances come with a personal guarantee, which makes you personally responsible if the business cannot pay. Some lenders also take a lien on personal assets. Before you sign, know exactly which of your assets the agreement can reach.
One structure, often called a rollover as business start-up (ROBS), moves retirement money into a new corporation's stock through a qualified plan. The IRS has studied these arrangements in its ROBS compliance project and notes that while they are not considered abusive tax avoidance in themselves, they can be run in ways that break the rules. Get advice from a tax professional who handles these plans before you move a dollar, and decide in advance how much of your retirement you are willing to lose if the business fails.
Withdrawing from a retirement account outright can trigger taxes and, depending on your age, penalties. That money also stops growing for retirement.
If you claim Social Security before full retirement age and keep earning, Social Security may withhold some benefits based on your earnings, as explained on its receiving benefits while working page. Self-employment income counts. If you are leaving an employer health plan to run your business, check Medicare enrollment timing so you do not face a gap in coverage or a late enrollment penalty.
| Source | What is at risk | Questions to ask |
|---|---|---|
| Revenue-based business funding | The business revenue, plus any personal guarantee | Is there a personal guarantee, and what does it cover? |
| SBA 7(a) loan | Business assets; personal guarantees are common | What collateral and guarantees does this lender require? |
| Retirement savings (ROBS or withdrawal) | Retirement money, taxes and possible penalties | What happens to my plan if the business closes? |
| Personal savings | Your cash cushion | How many months of living costs remain afterward? |
| SBA microloan | Usually the business; terms vary by lender | What is the total cost and the collateral? |
Some owners over 50 buy an existing business rather than start from zero, because it comes with customers, staff and a revenue history a funder can read. The SBA lists changes of ownership among the uses of 7(a) loans on its SBA 7(a) loan page, with a maximum loan amount of $5 million. A Small Business Development Center (SBDC) advisor or a SCORE mentor can help you review a seller's numbers before you make an offer, at no cost.

The offer shows the schedule and the full repayment amount up front, so you can check it against your retirement plan before you decide.
